Pre-2002 CFOs encouraged to seek formal grandfathering determination
Do you own a pre-2002 confined feeding operation? Help protect its future with a formal grandfathering determination from the NRCB
Did your operation exist, or was it permitted by the county, before the Agricultural Operation Practices Act (AOPA) came into effect on January 1, 2002? If so, now is the time to request a formal grandfathering determination from the Natural Resources Conservation Board (NRCB).
Here’s why:
Providing documentation for selling, refinancing, or expanding
If you ever need to sell, refinance, or expand your operation, buyers or bankers will likely require documentation from the NRCB of your permitted capacity.
Requesting a formal grandfathering determination now will allow you to start the process to obtain the documentation on your own terms and on your own schedule, instead of scrambling when you discover you need that piece of paper.
Records from 2002 are getting harder to find
It’s getting more difficult to find records from more than 20 years ago that prove the existence and capacity of your operation in 2002.
Requesting a formal grandfathering determination now will allow you to start the process before even more time passes and it gets even harder to find records.
Shorter processing time
The NRCB has dedicated resources in place until June 2025 to assist with your grandfathering determination request.
Requesting a formal grandfathering determination now, while these resources are available, will help reduce the time it takes to complete the process. Without these dedicated resources a formal grandfathering determination can take up to eight months.
Clarifying your capacity
You may be operating at a different capacity than on January 1, 2002.
